This privacy policy ("Privacy Policy") explains how we collect, use, share, disclose and protect Personal information pertaining to the Users of our services, including the Practitioners (as defined in the Terms of Use) , the End-Users (as defined in the Terms of Use), and the Visitors of Website (jointly referred to as “you” or “Users” in this Privacy Policy). This Privacy Policy demonstrates our commitment to the protection of your privacy and your personal information. Your access to our services is subject to this Privacy Policy and our Terms of Use.
By visiting the Website, providing us your information or using our services, you will be deemed to have read, understood and agreed to the practices outlined here and be bound by this privacy policy. You hereby consent to our collection, use, sharing and disclosure of your information as described in this privacy policy.

2. COLLECTION OF PERSONAL INFORMATION
Your personal details may be required by us to ensure better delivery of Services to you. When you use our services or interact with us, we may ask you to voluntarily share certain information that could be used to personally identify you. You hereby consent to the collection of such information by Surgiwise. Such information collected from you by Surgiwise may include (but is not limited to) the following:
i. contact details (including your email address, physical location and phone number);
ii. demographic data (including your gender, date of birth, locality);
iii. data pertaining to your previous communication with us;
iv. insurance details;
v. images and documents/ files voluntarily shared by you and any other information shared by you on phone or via email or post.
The information collected from the Users may constitute “Personal Information” or “Sensitive Personal Data or Information” under the SPI Rules.“Personal Information” is defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person.“Sensitive Personal Data or Information” of a person means personal information about that person relating to: passwords;ii. financial information such as bank accounts, credit and debit card details or other payment instrument details;iii. physical, physiological and mental health condition and sexual orientation;iv. medical records and history;v. biometric information;vi. information received by body corporate under lawful contract or otherwise;vii. visitor details as provided at the time of registration or thereafter; andviii. call data records. Collection, use and disclosure of information which has been designated as Personal Information or Sensitive Personal Data or Information requires your express consent. By affirming your assent to this Privacy Policy, you provide your consent to such use, collection and disclosure as required under applicable law.
Surgiwise will be free to use, collect and disclose information that is freely available in the public domain without your consent.
3. PRIVACY STATEMENTS
3.1 FOR ALL USERS :
This section applies to all users.
3.1.1 Any User that does not agree with any provisions of this privacy policy has the option to discontinue the services provided by Surgiwise immediately.
3.1.2 All Personal Information provided by user to Surgiwise, is voluntary. Surgiwise may use this information (a) to identify you, (b) for providing you Services, (c) in non-personally identifiable form for assessment of usage patterns and conducting research and analysis with a view to optimize and improve their Services, (d) for analyzing anonymized information for commercial purposes and publication, (e) for sharing such statistical or intelligence data in an aggregated or non-personally identifiable form with third parties and affiliates (f) for establishing better communication to ensure optimized delivery of services (g) for obtaining feedback regarding the Services, the Practitioners and their practice, (h) for improving customer support, (i) for contacting you to complete any incomplete transaction, (j) for offering new services, (k) for processing payment instructions including those involving independent third party service providers such as payment gateways, financial institutions, pre-paid instrument and wallet providers for facilitating or deferring payment .
3.1.3 If you have voluntarily provided your Personal Information to Surgiwise for any of the purposes stated above, you hereby consent to such collection and use of your information by Surgiwise.
3.1.4 Surgiwise does not control or endorse the content, messages or information found in any Services and, therefore, Surgiwise specifically disclaims any liability with regard to any outcomes resulting from your utilization of our Services, and you agree that you waive any claims against Surgiwise relating to same, and to the extent such waiver may be ineffective, you agree to release any claims against Surgiwise relating to the same.
3.1.5 You can amend your personal information by making the required changes on our member information page or by contacting us through privacy@surgiwise.com. We will try to update the particular details in our then active databases as soon as reasonably practicable. If Surgiwise has reasonable grounds to suspect that the information provided by you is untrue, inaccurate or incomplete, Surgiwise may, at its sole discretion, discontinue the provision of our Services to you. Under certain circumstances, Surgiwise will not update your Personal Data, including (a) where the Personal Data is opinion data, collected for evaluative purpose only; and (b) the Personal Data is in documents related to an ongoing prosecution.
3.1.6 If you wish to cancel your account or would prefer that we no longer use your information to provide you services, contact us through support@surgiwise.com. Your information will be retained by us in accordance with retention periods prescribed by law or recommended by regulators and industrial bodies. Your data may subsequently be anonymized and aggregated, and may be retained by us as long as necessary for us to provide our Services effectively. In certain circumstances, your data may have to be retained for a longer period.
3.1.7 If you wish to opt-out of receiving non-essential communications such as promotional and marketing-related information, please send us an email at support@surgiwise.com .
3.1.8 Surgiwise will collect such User’s credit card number and/or other financial institution information such as bank account numbers for billing and payment processes, including but not limited to the use and disclosure of such credit card number and information to third parties as necessary to complete online financial transactions. The User would be required to complete the authentication process to confirm verification. Credit-card/debit card transactions are done upon secure sites of approved payment gateways which are digitally under encryption, providing high security. However, Surgiwise provides you an option to not save your payment details. User is advised to follow discretion while using internet technology, in view of possibility of security issues.
3.1.9 When a User visits the Website, Surgiwise automatically receives the URL of the site and the Internet Protocol (IP) address of each User’s computer (or the proxy server a User used to access the World Wide Web), User’s computer operating system and type of web browser, email patterns, as well as the name of User’s ISP. This information is used to analyze overall trends to help Surgiwise improve its services. Surgiwise may share some aggregated findings in anonymized form with stake-holders, advertisers and sponsors, for business growth.
3.1.10 Our Website uses temporary cookies to store certain personal data or information that is used by Surgiwise and its service providers for website administration and research. If cookies are disabled by the User, they may still be able to use the Website, but certain features may be limited.
3.1.11 Unregistered Users may have limited access to the Website without creating an account. An account needs to be created, if a User wants to access all the features and benefits on our Website. Some personal information needs to be provided by the User to create such account. This information will enable Surgiwise and others to identify the User. User may be required to provide personal details like name, age, phone number, email address, country, ZIP/postal code, User ID, password chosen by the User and valid financial account information. Other optional information may be requested on the registration page, including consent for receiving promotional offers and other details to enable provision of more customized services to the User.
3.1.12 Surgiwise does not exercise control over the privacy practices or policies of any third party websites displayed as search results or links from within its services. Such websites may place their own cookies or other files on the Users’ computer or collect personal information from the Users, for which Surgiwise is not responsible or liable. Surgiwise takes no responsibility for the accuracy or quality of information or services available on such websites.
3.1.13 Surgiwise website and Services may enable User to interact and communicate with other Users or individuals. Such individuals are not authorized Surgiwise representatives, and Surgiwise takes no responsibility for their opinions or actions. Surgiwise will not be held liable for misuse of any information or data shared or collected through such interactions by any individuals or agencies.
3.1.14 Surgiwise may collect information about the visitors of the Website from other sources, such as public records or private organisations, for registration of Users. The User must agree to collection, use, storage and disclosure of such data, under the Terms of Use.
3.1.15 Surgiwise has implemented standard market practices and technical measures to prevent improper or unauthorised use of personal data under its control. However, in event of data loss or theft due to unauthorized access to the User’s electronic devices through which the User avails the Services, Surgiwise shall not be held liable for any loss whatsoever incurred by the User.
3.1.16 Surgiwise implements reasonable and comprehensive information security practices and programs involving stringent security control measures appropriate to and in accordance with the information being collected and the nature of Surgiwise’s business.
3.1.17 Surgiwise takes your right to privacy very seriously and other than as specifically stated in this Privacy Policy, will only disclose your Personal Information if it is required to do so by law, or when Surgiwise, in its sole discretion, deems it necessary in order to protect its rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk, or to enforce or apply the Terms of Use.
3.2 PRACTITIONERS NOTE:
This section applies to all Practitioners.
3.2.1 As part of the registration, application creation and submission process applicable for Practitioners on Surgiwise, certain Personal Information or Sensitive Personal Data might be collected from the Practitioners.
3.2.2 This Privacy Policy is applicable to all Practitioners, and all Practitioners should read and understand the privacy statements prior to submitting any Personal Data to Surgiwise.
3.2.3 Practitioners’ personally identifiable information, which they choose to provide to Surgiwise, is used to help them describe and identify themselves. This information is exclusively owned by Surgiwise and you hereby consent to Surgiwise collecting, using, processing and/or disclosing this information for the purposes stated here:
(a) in aggregated or non-personally identifiable form for commercial use, research and statistical analysis and business intelligence purposes,
(b) for sharing and transfer of such intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates.
(c) commercial purposes and publishing
(d) contacting Practitioners for offering new products or services
(e) contacting Practitioners for taking product feedback.
(f) analyzing software usage patterns for improving product design and utility.
3.2.4 Practitioners’ information is automatically listed on Surgiwise Website for every ‘Doctor’ or ‘Clinic’ or ‘Hospital’ added to the database using its software. Any such personally identifiable information listed on the Website is provided to Surgiwise by Practitioners themselves, or is collected by Surgiwise from the public domain. While Surgiwise will take reasonable steps to confirm the accuracy of this data, Surgiwise displays such information on its Website on an as-is basis providing no warranty or guarantee regarding the accuracy or completeness of the information. We thereby strongly encourage Practitioners to check their information from time to time, and inform us immediately in case of discrepancy or inaccuracy. .
3.2.5 Surgiwise may also display information for Practitioners who have not signed up or registered for the Services. Such Information will be provided by Practitioners themselves, or collected from the public domain. Surgiwise makes reasonable effort to verify such information, however, we do not undertake any liability for incorrect or incomplete information appearing on the Website for Practitioners.
3.3 END-USERS NOTE:
This section applies to all End-Users.
i. As part of the registration, application creation and submission process applicable for End-Users on Surgiwise, certain Personal Information or Sensitive Personal Data might be collected from the End-Users.
ii. All the statements in this Privacy Policy apply to all End-Users, and all End-Users are therefore required to read and understand the privacy statements prior to submitting any personal information.
iii. If you do not agree with the process of information collection and usage, or information was inadvertently submitted prior to reading the privacy statements, you can opt to modify or delete such information by using options provided on the Website. You can also contact us on privacy@surgiwise.com for information regarding your personal data and to raise request to delete it.
iv. Personal Information provided by End-Users on the Website is used to help them describe/identify themselves. Surgiwise may collect and exclusively own other information from End-Users that does not personally identify them, such as patterns of utilization. Such information may be used by us in an aggregated or non-personally identifiable form for research and analysis, which may be shared with third parties and affiliates. Surgiwise may use anonymized End-User information for the following purposes:
(a) Analyzing software usage patterns for improving product design and utility.
(b) Conducting analysis for research and development of new technologies and products
(c) Sharing analysis of such information with third parties for commercial use.
v. Surgiwise may communicate with the End-Users through email, phone, texts and other available means.The End-Users can change their e-mail and contact preferences at any time by logging into their Account at www.surgiwise.com and changing the account settings.
vi. Surgiwise may conduct User surveys and organize contests or offer rewards to collect information about End-Users' preferences. These surveys are optional and the responses will be kept anonymous. The demographic and health information collected by us will be used to improve our Services and tailor them to the preferences of End-Users. This may include targeting advertising to End-Users about our Services.
vii. Surgiwise may keep complete records of electronic and telephone communications as well as all online and offline interactions with Users, for the purpose of administration of Services, customer support, research and development and for better listing of Practitioners.
viii. All Surgiwise employees and data processors, who have access to, and are associated with the processing of sensitive personal data or information, are obliged to respect the confidentiality of End-Users’ sensitive personal data and information.
ix. Surgiwise may also disclose or transfer End-Users’ personal information present in its database, to a third party as part of reorganization or sale of the assets of a Surgiwise corporation division or company. Any third party to which Surgiwise transfers or sells its assets to will have the right to continue to use the personal and other information that End-Users provide to us, in accordance with the Terms of Use.
x. Third party contractors working with Surgiwise for delivery of services or maintenance of our website, will have rights to access and disclose the personal information collected during the process of provision of these Services, in accordance with their own privacy policies. Surgiwise takes no responsibility and will not be held liable for the actions of such third parties.
3.4 CASUAL VISITORS NOTE:
i. Surgiwise does not automatically collect sensitive personal data or information from casual visitors of this website.
ii. However, casual visitors are also required to read and understand the privacy statements, as certain provisions of this Privacy Policy are applicable to them. They should leave the website immediately if they fail to do so.
iii. If a casual visitor inadvertently browses any other page of this Website prior to reading the privacy statements, and does not agree with the manner in which such information is obtained, stored or used, merely quitting this browser application should ordinarily clear all temporary cookies installed by Surgiwise. All visitors, however, are encouraged to use the “clear cookies” function of their browsers to ensure such clearing / deletion, as Surgiwise cannot offer any guarantee regarding the software/ hardware being used by all Visitors.

You are not a casual visitor if you have willingly submitted any personal data or information to Surgwise through any means, including email, post or through the registration process on the Website. All such visitors will be deemed to be, and will be treated as, Users for the purposes of this Privacy Policy, and all the statements in this Privacy Policy will apply to such persons.
4. CONFIDENTIALITY AND SECURITY
i. Your Personal Information is maintained by Surgiwise in electronic form on its equipment, and on the equipment of its employees. Such information may also be converted to physical form as per our discretion and requirement. Surgiwise takes standard precautions to protect your personal information both online and offline, and implements reasonable security practices and measures including technical, operational and physical security control measures that are commensurate with respect to the information being collected and the nature of our business.
ii. Surgiwise administrators will not be aware of your password. It is important for you to protect yourself against unauthorized access to your password. Surgiwise does not undertake any liability for any unauthorized access to your account and password. If you suspect any unauthorized use of your account, you must immediately notify Surgiwise by sending an email to customerfirst@surgiwise.com. You shall be liable to indemnify Surgiwise due to any loss suffered by it due to such unauthorized use of your account and password.
iii. Surgiwise employees, agents or partners and third parties are granted access to User Information only on a need-to-know basis, and all such employees are bound by strict confidentiality obligations.
iv. Surgiwise assists doctors and patients to organize and access information relevant to them. Surgiwise may, therefore, retain and submit such records to the appropriate authorities, or to the concerned doctors or patients.
v. Surgiwise is not responsible for the confidentiality, security or distribution of your personal information by our partners and third parties outside the scope of our agreement with such partners and third parties. Further, Surgiwise shall not be responsible for any breach of security or for any actions of third parties or events that are beyond the reasonable control of Surgiwise including but not limited to acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption and poor quality of Internet service or telephone network.
5. CHANGE TO PRIVACY POLICY
Surgiwise may update this Privacy Policy at any time, with or without advance notice. In case of significant changes in the Privacy Policy or in the way Surgiwise treats User’s personally identifiable information, Surgiwise will display a notice on the Website or send Users an email, to enable you to review the changed terms prior to continuing to use the Services. If you object to any of the changes to our terms, and you no longer wish to use the Services, you may contact support@surgiwise.com to deactivate your account. Unless stated otherwise, Surgiwise’s current Privacy Policy applies to all information that Surgiwise has about You and Your account. If a User uses the Services or accesses the Website after a notice of changes has been sent to such User or published on the Website, such User hereby provides his/her/its consent to the changed terms.
6. CHILDREN'S AND MINOR'S PRIVACY
Surgiwise strongly encourages parents and guardians to supervise the online activities of their minor children and consider using parental control tools to help provide a child-friendly online environment and prevent minors from disclosing personally identifiable information online without parental permission.
